Through the Pet Insurance Act, state law protects policyholders. Its provisions are codified in Title 24-A, sections 3151 through 3161 of the Maine Revised Statutes. These rules became law through LD 482 (P.L. 2021, c. 562); effective January 1, 2023.
For those statutes, regulators place the state among model adoptions on the NAIC model law record. Across North America, 7.6 million pets have plans, covering 4.27% of U.S. pets; dog coverage is 5.99%, and cat coverage is 2.29%.
Maine laws for pet insurance
The state statute clearly limits how policies operate. It also requires companies to tell you certain information before you buy. A waiting period means the days that follow your plan purchase and end when coverage starts paying for care. Insurers must follow strict timing limits under Maine's waiting period rules:
- Waiting periods for illness and orthopedic conditions cannot exceed 30 days.
- Accidents cannot have a waiting period.
- Insurers cannot apply another waiting period when a policy renews.
New policyholders can use a free-look period to cancel within a short window and receive a refund. You may return a new policy for a premium refund within 15 days of receipt under state disclosure and free-look law. According to that statute, insurers must disclose exclusions. Examples include pre-existing, hereditary, congenital, and chronic conditions.
For pre-existing conditions, the law provides 1 definition so companies cannot set their own rules. Maine's legal definitions call a pre-existing condition any condition involving vet advice, treatment, or signs before coverage starts or during a waiting period. If the insurer refuses a claim on pre-existing grounds, the insurer must prove that the exclusion applies.
Separate state rules address agent training and routine care. A wellness plan gives you optional coverage for routine vet visits. Buying a wellness plan cannot be required as a condition of purchasing a policy under the wellness program statute. Finally, state training rules require agents to hold licenses and finish specific training before selling a plan.
