Pet policies fall under property insurance under state law rather than marine and transportation coverage. Effective January 1, 2026 (Act 79, SLH 2025), every seller falls under the oversight of the Hawaii Insurance Division through HRS Chapter 431, Article 33.
At purchase, your insurer must clearly list exclusions and keep routine wellness plans separate. It must also prove any pre-existing claim denial. Basic accident-only coverage for dogs averages $190 a year or $16 a month across the US. For cats, accident-only plans average $112 each year, or $9 each month.
Hawaii pet insurance laws
Consumer protections under Haw. Rev. Stat. §§ 431:33-101–431:33-109 follow this state's national model law adoption. Policies sold here must meet strict rules for agent training, wellness plans, disclosures, refunds, and waiting times:
- Waiting-period caps: After you buy a policy, a waiting period passes before coverage begins. State waiting-period rules limit illness and orthopedic waits to 30 days. Accidents cannot have a waiting period, and insurers cannot impose one again when you renew.
- Free-look period: You may cancel a new policy and receive a refund during its free-look period. The policy return statute lets you return a new policy for a premium refund within 30 days after receipt.
- Required disclosures: Policy exclusions such as chronic, congenital, hereditary, and pre-existing conditions must appear in their policy documents.
- Under the statutory definitions, a pre-existing condition means vet advice, treatment, or signs that occur before coverage or during a waiting period. When a claim is denied as pre-existing, the insurer must prove that the exclusion applies.
- According to the marketing laws, wellness plans may not be marketed as pet insurance. Purchasing pet insurance cannot require you to purchase a wellness plan.
- Agent training: Before selling a policy, agents must have licenses and complete pet insurance training under producer licensing rules.
