  • Waiting, accident: The law doesn't allow a waiting period for accidents.
  • Renewal no wait: Renewal cannot bring back a waiting period.
  • Free look: After receiving a new policy, you may return it for a premium refund within 30 days.

The Delaware Department of Insurance oversees pet coverage under Delaware's Pet Insurance Act. In Delaware Code, lawmakers adopted the NAIC model law as Title 18, Sections 8801 to 8809. Effective date: August 31, 2023 (HB 156, 84 Del. Laws chapter. 184).

Sellers must follow clear rules for explaining coverage and handling your claims because a dedicated state law applies. At the latest count, Across North America, 7.6 million pets had coverage. National insurers offer policies here with state-mandated consumer protections.

A 30-day free-look period is provided by the Delaware Pet Insurance Act when you buy a new policy. After you receive a new policy, you can use the free-look period to return it for a premium refund during the allowed window.

The waiting period runs from policy purchase until coverage starts, and state law limits how long it can last. Delaware's pet insurance statute requires companies to follow strict limits on delays and exclusions:

  • Waits for illness and orthopedic conditions cannot exceed 30 days.
  • A waiting period is prohibited for accidents.
  • Insurers can’t apply a waiting period again at renewal.
  • Insurers must disclose exclusions, including pre-existing, hereditary, congenital, and chronic conditions.

One definition covers pre-existing conditions under the law. This describes any condition involving veterinary advice, treatment, or signs that a pet had during a waiting period, or before coverage started. If an insurer refuses a claim on pre-existing grounds, state law requires the insurer to prove the exclusion applies.

Clear rules also cover routine care and sales practices. Buying a policy can't require you to purchase a wellness plan, which also can't be marketed as pet insurance. Before selling pet insurance, agents must have licenses and finish pet insurance training.

We use national cost figures from NAPHIA because state averages aren't published. Willis Towers Watson compiled these figures, which cover the US rather than Delaware. For dogs, the US average premium for accident and illness coverage is $836 each year ($70 each month). The national average for a cat with the same coverage is $435 each year, or $36 each month. In the US, 4.27% of pets are covered; dog coverage is 5.99%, compared with 2.29% for cats. The quote changes with your pet's ZIP code, species, age, and breed.
